Cross-border Mediation: The New Way Forward for Businesses

It marks the second part of the series on mediation and consisted of a fireside chat with experts from 4 continents as well as multi-jurisdictional practitioners and end-users.

2021 Colloquium on International Law
In the past two years, the pandemic has turned the world upside down and changed the way we conduct our affairs and business. The COVID-19 pandemic lingers unto this very day – its impact has long outlived what its name bears. While the medical sector has been endeavoring to battle against the virus to save human lives, the business sector has been striving to thrive against all odds. How about the response of the legal sector? As the China-US trade negotiations are restarting, the WTO is being revitalised and the buiness community is looking forward to the extension of application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) to the Hong Kong SAR.
The 2021 Colloquium on International Law was organized by The Asian Academy of International Law and Chinese Society of International Law, and supported by more than 20 organizations such as IDRRMI, HKMC etc,. The Colloquium was held on 19 November 2021 under the theme ‘Development of International Trade Law in the [Post-]Pandemic Era’, examining the applicability of the current provisions during the pandemic time as well as afterwards.

The Chairman of the IDRRMI, Dr. Francis Law, was on the speaking panel of the Seminar for Celebrating the 3rd Anniversary of the JIMC-Kyoto “The Future of International Commercial Mediation in Asia -Focusing on Online mediation and Collaborations among International Mediation Centers (IMCs)”, successfully organised by the Japan International Mediation Center in Kyoto (JIMC-Kyoto), Japan Association of Arbitrators (JAA) and Doshisha University Research Center for International Transactions and Law (RECITAL) on 19 November 2021.

The inauguration ceremony of the Hong Kong Adjudication Centre (HKADJC) was held on the 28th of September 2021 at 3:00 pm. The centre was officially launched under the witness of representatives from the Department of Justices HKSAR and leaders from different professional industries, including building management, construction, innovation and technology, and more.
Established under the International Dispute Resolution and Risk Management Insitute, the HKADJC aims to provide professional adjudication service, filling the service gap that is currently in place in the professional dispute resolution area in Hong Kong. By collaborating with our 280 allied partners, HKADJC would uplift the professionalism of the dispute resolution industry, support different industries, and building international influence.

ICS HK & WISTA HK: Webinar 1 / Safe Port - Eastern City to Ocean Victory & Beyond
The Institute of Chartered Shipbrokers Hong Kong Branch (ICS HK) and the Women's International Shipping & Trade Association (WISTA HK) co-organized “Webinar 1: Safe Port – Eastern City to Ocean Victory & Beyond” on the 16th June 2021.
The panel looked at the development of law, “The Eastern City”, and considered the questions of absolute versus qualified warranties, using various references. The panel also addressed questions such as - safe port at the time of the nomination with nothing to suggest that it may become unsafe and then becoming so while the vessel is in the port; unsafe at the time of nomination but safe when the vessel arrives and is at the port; consequences of owner’s decision to accept the orders to sail to an unsafe port and the issues of forfeiting the right to damages, mitigation, and indemnity. The panel then moved on to the practical considerations to avoid disputes by bringing in clarity.

2019 UNCITRAL Asia Pacific Day
The United Nations Commission on International Trade Law (UNCITRAL) was established by the United Nations General Assembly Resolution 2205 (XXI) of 17 December 1966 and has since come to be the core legal body of the United Nations system in the field of international trade law. The UNCITRAL Regional Centre for Asia and the Pacific (UNCITRAL RCAP) established UNCITRAL Asia Pacific Day in 2014 to celebrate this historical resolution.
This year, an initial eleven universities across the region have joined the annual celebration to commemorate the establishment of UNCITRAL and promote awareness of international trade standards and norms, particularly those endorsed by UNCITRAL.
